You are noticed to appear before the State Oil and Gas Board of

Mississippi at its regular May term, being on the 17th day of May 2023

to show cause, if any you can, why the Petition of MJD Production,

Inc. ("Petitioner") being Docket No. 128-2023-D at said Board,

seeking authority to force integrate, with alternate charges, an 80+-

acre oil unit, and grant related relief, should not be granted.

PROPOSED 80 ACRE OIL UNIT:

The Southwest Quarter of the Southwest Quarter of Section 26 and the

Northwest Quarter of the Northwest Quarter of Section 35, Township 10

North, Range 9 West, West Eucutta Field, Wayne County, Mississippi and

containing 80 acres, more or less.

Said meeting of said Board shall begin at 9:00 a.m. on Wednesday, May

17, 2023 in the hearing room, Suite E, 500 Greymont Avenue, Jackson,

Mississippi.

Petitioner proposes to drill the Pace-Moore 26-13 No. 1 Well at an

exception location approximately 400' from the west line and 600'

from the south line of Section 26, Township 10 North, Range 9 West to an

approximate depth of 8600' to test the Paluxy formation and all other

formations and pools which may be encountered, in the above described

80+- acre oil unit. The proposed well will be located less than 500'

from west unit line and closer to the P. O. & G. Operating, LLC - J.

P. Edwards No. 1 Well than is authorized by the Statewide Rules and

Regulations. The proposed exception location is necessary for geologic

reasons. Sufficient acreage of the proposed Unit appears to be

underlain by productive intervals of the Paluxy Formation and the Well

should be granted a full allowable.

A copy of said Petition is on file in the office of the State Oil and

Gas Board, Suite E, 500 Greymont Avenue, Jackson, Mississippi and may be

there examined by any persons interested. At said hearing, all

interested persons may appear and be heard.

If you intend to contest the docket or request a continuance you must

notify the Board and the Petitioner's attorney of your intention in

writing not later than 5:00 p.m. Tuesday, May 9, 2023. Failure to so

notify the Board and the Petitioner's attorney shall be a waiver of

your right to contest or request continuance.

You are advised the Board may adopt orders concerning a Petition that

may differ from the relief requested by the Petitioner and Board will

enter such order or orders as in its judgment may be appropriate in

accordance with the evidence presented.

In accordance with Section 7-7-213, Miss. Code Ann. (1972), notice is

hereby given that a copy of the 2021 audit of Wayne County is on file in

the Chancery Clerk's office of Wayne County.

In accordance with Section 7-7-221, Miss. Code Ann. (1972), the

following synopsis of the governmental funds of Wayne County audit for

fiscal year ending 9-30-2021 is provided in the format prescribed by the

State Auditor:

Revenues 10-01-2020 to 9-30- 2021 $ 16,442,621 Expenditures 10-01- 2020

to 9-30- 2021 $ 13,825,450 Cash and investments at 9-30- 2021 $

9,430,038

A copy of the audit report containing all findings and recommendations

as well as exceptions, if applicable, can be obtained for $15.00 or, if

available on the OSA website, $25.00, by writing to the Office of the

State Auditor, Post Office Box 956, Jackson, MS 39205. The website

address is: www.osa.state.ms.us.

A copy of the audit report is also on file and available for public

inspection at the Wayne County library.

In accordance with Section 31-7-115, Miss. Code Ann. (1972), the audit

report of the county purchase clerk and inventory control clerk is

Our findings and recommendations and your responses are disclosed below.

Significant Deficiency 2021-001.

The County did not complete the federal grant activity schedule. Repeat

Finding Yes

Criteria An effective system of internal control over federal grants

includes properly identifying all federal programs and related

disbursements.

Condition As reported in the prior year's audit report, the County did

not complete the federal grant activity schedule for the fiscal year

ended September 30, 2021.

Cause The County lacked the necessary controls to complete the federal

grant activity schedule for the fiscal year ended September 30, 2021.

Effect The failure to properly complete the federal grant activity

schedule increases the possibility of not reporting all federal

disbursements and could affect eh requirement to have a Single Audit.

Recommendation The Board of Supervisors should implement controls to

ensure the federal grant activity schedule is prepared each year.

Views of Responsible Official(s) The County will put a grant activity

schedule into place starting the new fiscal year

2021-002.

Controls over repayment of interfund advances should be strengthened.

Repeat Finding Yes

Criteria The Mississippi Code is silent regarding the authority of the

County to make interfund loans.

Condition As reported in the prior year's audit report, the County has

interfund loans outstanding that are over one year old. The loans were

not repaid as of September 30, 2021.

Cause The County lacked the necessary controls to ensure that interfund

loans were repaid within one year.

Effect Failure of the Board of Supervisors to ensure repayment of these

loans is an illegal diversion of legally restricted funds.

Recommendation For any interfund loan made, the Board of Supervisors

should approve and record in the board minutes the reason for the loan,

when the loan will be repaid and the source of the funds for repayment.

The Board of Supervisors should ensure these old loans are repaid by

approving and recording in the minutes a repayment schedule and

complying with the repayment schedule.

Views of Responsible Official(s) Plan of action was adopted on November

1, 2021. Paybacks of advances will continue for four (4) more years.
